We advise businesses on entity formation, corporate governance, contracts, transactions and succession planning. Our clients include family enterprises, established companies and nonprofits throughout Idaho. We emphasize sound structure and clear agreements so that our clients can avoid disputes instead of litigating them.
Real Estate & Land Use
We handle purchases and sales, leasing, easements, boundary and title issues and development matters. We also represent clients before city and county planning authorities on zoning, conditional use permits and other land use entitlements.
Homeowners & Community Associations
We represent homeowners associations, road associations and other community organizations on governance, CC&R interpretation and amendment, covenant enforcement, assessments and disputes. We advise boards on their duties and help associations resolve conflicts before they turn into litigation.
Water Law
Agribusiness & Agriculture
Water rights are among the most valuable and most frequently misunderstood assets in Idaho. We assist clients with water right transfers, ownership changes, adjudication issues and disputes, and we regularly work with the Idaho Department of Water Resources and other relevant agencies on our clients’ behalf.
Estate Planning
Idaho agriculture raises legal question that a general business practice may not reach, including farm and ranch transactions, agricultural leases, water and irrigation issues and succession planning for operations intended to stay in the family. We are familiar with this work becasue many of our clients make their living in agriculture.
We prepare wills, powers of attorney, and health care directives tailored to each client’s needs, with experience in planning for family businesses, farms and real property holdings.
Probate & Estate Administration
We guide personal representatives and families through the Idaho probate process. Our goal is to make a difficult time easier by handling the court process efficiently and keeping families informed.
Guardianships & Conservatorships
When a loved one cannot manage his or her own affairs, we help families establish guardianships and conservatorships. We also counsel appointed guardians and conservators on their ongoing duties to the court and to the protected person.
Civil & Commercial Litigation
When a dispute cannot be resolved through negotiation, we represent clients in Idaho state and federal courts. Our litigation practice includes commercial and contract disputes, real property and boundary litigation, construction disputes and probate litigation.
